Stage 2: creating offensive words, malicious rumors and slander

Without knowing the background and lacking evidence, Helen Sun created attacking words with bare hands, attacking the victim for forging academic qualifications, forging work experience, etc.

Stage 4: Launching the Attack

On June 2, 2018, in the Ivy League Schools group, Helen Sun invited Kevin CHENG to join the group, and Kevin CHENG posted an attack text.

A group of friends forwarded the victim's clarification statement and everyone's opinions in the Ivy League Schools group, and immediately received a call from Helen Sun Sun Yu, who was forced to accept accusations, abuse, and threats for tens of minutes.

After S wrote a fact-clearing statement, the countersigning alumni either quitted or took a neutral stance. However you didn't cease the personal attacks on S, and incessantly continued such attacks in Wechat groups in July, August, September, October and November. Even after some alumni associations stated a neutral stance and withheld authority for the ongoing matter while some alumni associations stated their withdrawal, your continuous acts of spreading untrue remarks thereafter aimed at S in the name of the such associations were suspected of violating the signed right and reputation right of relevant alumni associations. Your acts of forging untrue remarks of slander, libel and accusations as well as the mass, repeated dissemination of such remarks already violated the reputation right of S, and were suspected of infringing the clauses stated in the national Criminal Law regarding personal abuse and reputation tort. I, as the lawyer in this case, hereby appeal to the lady Helen Sun to stop immediately all forms of personal attacks, and make public apologies to S, and restore my client's reputation in the area thus affected.

According to relevant national laws, the reputation right of the legal person and the natural person is protected by laws:

According to the Clause 101 in the "General Principles of Civil Law", it is stipulated that: Citizens and legal persons shall enjoy the right of reputation. The personality of the citizens shall be protected by law, and the use of insults, libel or other means to damage the reputation of citizens or legal persons shall be prohibited.

According to the Clause 2 in the "Tort Law of the People's Republic of China", it is stipulated that: Those who infringe upon civil rights and interests shall be subject to the tort liability according to this Law. "Civil rights and interests" used in this Law shall include the right to life, the right to health, the right to name, the right to reputation, the right to honor, right to self image, right of privacy, marital autonomy, guardianship, ownership, usufruct, security, interest, copyright, patent right, exclusive right to use a trademark, right to discovery, equities, right of succession, and other personal and property rights and interests.

According to the Clause 246 in the "Criminal Law of the People's Republic of China", it is stipulated that: Whoever, by violence or other methods, publicly humiliates another person or invent stories to defame him, if the circumstances are serious, shall be sentenced to fixed-term imprisonment of not more than three years, criminal detention, public surveillance or deprivation of political rights.

Based on the facts above stated, according to relevant provisions in the "General Principles of Civil Law", "Tort Law of the People's Republic of China", "Criminal Law of the People's Republic of China" and "Regulation on the Protection of the Right to Network Dissemination of Information ", I hereby claim and state the following to you:

1.Your spreading, dissemination and exaggeration of untrue remarks about S on public network information platforms grievously misled the groups of alumni and relevant public, and caused severe harassment towards S, and thus violated the legal rights and interests of S.

2.Your acts of maliciously spreading and forging unverified relevant information constituted an infringement on the reputation right of S, and were suspected to constitute libel and insults towards S.

3.In the name of the client, I demand that you stop spreading untrue information and eliminate the negative influence on the already affected network information platforms and offer public apologies.

Failing to make such reparation, my client shall adopt all legal measures including but not limited to litigation, by which you shall be held liable for legal responsibilities including economic compensation, mental damages, etc. For your knowledge!
